1. Eligibility & Use of the Site

By using the Site, you represent and warrant that:

2. Not Medical Advice; No Provider–Patient Relationship via the Site

The content on this Site is provided for general informational and educational purposes only and does not constitute medical advice, diagnosis, or treatment.

  • Information on the Site, including articles, service descriptions, before-and-after photos, FAQs, or videos, should not be considered a substitute for professional medical advice or in-person consultation.

3. Intellectual Property Rights

The Site and its entire contents, features, and functionality—including text, graphics, logos, icons, images, video, audio, design, and software—are owned by Luminé Aesthetics or its licensors and are protected by copyright, trademark, and other intellectual property laws.

Except as expressly permitted in these Terms, you may not:

  • Copy, reproduce, distribute, modify, create derivative works, publicly display, publicly perform, republish, download, store, or transmit any material from the Site without our prior written consent.
  • Use any trademarks, service marks, or logos displayed on the Site without our prior written permission.

You may temporarily download or print a single copy of pages from the Site for your personal, non-commercial use, provided you do not remove any proprietary notices.

4. User Conduct & Prohibited Uses

We reserve the right to accept, reschedule, or refuse appointments in our sole discretion.

TO THE FULLEST EXTENT PERMITTED BY LAW, LUMINÉ AESTHETICS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Site will be uninterrupted, secure, or error-free;
  • Defects will be corrected; or
  • The Site or the server that makes it available are free of viruses or other harmful components.

Any reliance you place on information available through the Site is strictly at your own risk.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL LUMINÉ AESTHETICS OR ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, OR OTHER DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF, OR INABILITY TO USE, THE SITE.

TO THE EXTENT PERMITTED BY LAW, LUMINÉ’S TOTAL AGGREGATE LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THE SITE OR THESE TERMS SHALL NOT EXCEED ONE HUNDRED DOLLARS (US $100).

Some jurisdictions do not allow limitations on certain types of damages, so some of the above limitations may not apply to you.

11. Indemnification

You agree to indemnify, defend, and hold harmless Luminé Aesthetics and its owners, officers, employees, contractors, and agents from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or related to:

  • Your violation of these Terms; or
  • Your violation of any law or the rights of a third party.

12. Changes to the Site and These Terms

We may update or modify the Site, or these Terms, at any time. When we make changes, we will update the “Last Updated” date at the top of these Terms.

Your continued use of the Site after changes have been posted will constitute your acceptance of the revised Terms. If you do not agree to the changes, you must stop using the Site.

13. Governing Law & Jurisdiction

These Terms and your use of the Site are governed by the laws of the State of Indiana, without regard to its conflict of law principles.

You agree that any legal action or proceeding arising out of or related to the Site or these Terms shall be brought exclusively in the state or federal courts located in or serving Marion County, Indiana, and you consent to the personal jurisdiction of such courts.

14. Severability & Waiver

If any provision of these Terms is found to be invalid, illegal, or unenforceable, that provision shall be enforced to the maximum extent permissible and the remaining provisions shall remain in full force and effect.

Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.

15. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices or agreements referenced herein, constitute the entire agreement between you and Luminé Aesthetics regarding your use of the Site and supersede all prior or contemporaneous understandings, agreements, or representations.
